Terms of Use and Purchase

Please read these terms carefully before using the service.

These terms of use and purchase apply to the use of the online service maintained by Suomen elämykset Oy (Business ID: 3612111-1, hereinafter "Service Provider") and to gift cards purchased through the service. By using the online service or purchasing a gift card, you accept these terms in full. The Service acts as an intermediary platform between customers and businesses offering services. The Service Provider does not produce, organise or deliver the services covered by gift cards, unless otherwise stated in connection with a specific service.

2. Definitions

In these terms: • Service refers to the website and related services. • Service Provider refers to the company maintaining the online service. • Merchant Partner refers to a business or entrepreneur that offers services or products for use with gift cards. • Customer refers to a person or company that purchases or uses a gift card. • Gift Card refers to a digital or other identifier that entitles the holder to use a Merchant Partner's service or product in accordance with the terms.

3. Nature of the Service

The Service acts as a gift card sales and redemption platform. The Service Provider receives the customer's payment and delivers the gift card to the customer. The service or product contained in the gift card is always delivered by the respective Merchant Partner. The Service Provider is not responsible for the content, quality, safety, availability or delivery of the service offered by the Merchant Partner. When the customer uses a gift card, a contractual relationship regarding service delivery is formed between the customer and the Merchant Partner.

4. Purchasing a Gift Card

Gift cards can be purchased using the payment methods available in the service at any given time. An external payment service provider is used for payment processing. Payment information is handled according to that provider's terms. After purchase, the customer receives a gift card code or other identifier electronically, or if the customer selects a physical gift card, it is delivered by post to the address provided. The Service Provider is not responsible if the gift card is lost during delivery. The gift card price is determined by the price list in effect at the time of purchase. The gift card value and purchase price remain valid for the gift card's validity period (365 days from purchase), even if the price of the service or product changes later, unless otherwise stated. The Service Provider reserves the right to cancel or reject an order if there is reason to suspect misuse, payment fraud or other unlawful activity.

5. Gift Card Validity

Unless otherwise stated in connection with the gift card, the gift card is valid for 365 days from the date of purchase. After the validity period expires, an unused gift card cannot be redeemed and its value is not refunded. Exchanging a gift card for another service does not extend the original validity period, unless otherwise stated.

6. Using a Gift Card

The gift card is used according to the instructions provided in the service. The gift card can be used in full or in part only when the specific gift card's terms permit it. Service or booking availability depends on the Merchant Partner and the Service Provider does not guarantee availability at any specific time. Merchant Partners may have service-specific conditions, age limits, safety requirements or other participation terms. The customer is responsible for checking these before booking or using the service. If a physical gift card is exchanged for another gift card or service, the customer does not automatically receive a new physical gift card. The customer may separately order a new physical gift card for an additional fee as applicable.

7. Cancellation Rights and Returns

Consumer customers have the right to return an unused gift card within 30 days of purchase and receive a refund to the original payment method. Alternatively, the customer may exchange an unused gift card for another service or gift card at no additional cost during the gift card's validity period, unless special terms for exchanges have been separately stated. The cancellation or return right applies only to unused gift cards. The cancellation or return right ends if: • the gift card has been redeemed or used in full or in part; • a service based on the gift card has been booked or delivered; • the customer has used the benefit offered by the gift card. Refunds are processed to the original payment method within a reasonable time after the approved return.

8. Situations Where Service Cannot Be Delivered

If the Merchant Partner is unable to deliver the service covered by the gift card, the Service Provider may at its discretion: • offer an equivalent replacement gift card; • enable exchange of the gift card for another service; or • arrange other reasonable compensation. The Service Provider is not, however, responsible for the Merchant Partner's operations, insolvency or cessation of business beyond what mandatory legislation requires.

9. Gift Card Security

The customer is responsible for the careful safekeeping of the gift card code, identifier and other access credentials. The Service Provider is not liable for damages resulting from: • a lost gift card; • a gift card code disclosed to a third party; • the customer's negligence; • unauthorised use after the gift card has been delivered to the customer. The first successful redemption is considered valid use of the gift card.

10. User Obligations

The user agrees to use the service in accordance with the law, good practice and these terms. The user may not: • use the service for fraudulent or unlawful purposes; • disrupt the service's operation; • attempt to circumvent the service's technical security measures; • use the service in a manner that causes harm to the Service Provider, Merchant Partners or other users.

11. Limitation of Liability

The Service Provider is responsible only for providing the service platform and facilitating gift card sales. The Service Provider is not liable for: • the quality of services offered by Merchant Partners; • service safety; • service availability; • incorrect information provided by Merchant Partners; • indirect or consequential damages; • lost profit, revenue or business benefit. The Service Provider's total liability is limited to the share of a single (1) payment that the Service Provider has received as its own portion, unless mandatory legislation provides otherwise.

12. Modification and Suspension of Service

The Service Provider has the right to modify, suspend or discontinue the service or parts of it at any time. The Service Provider has the right to block access to the service or cancel orders on grounds of suspected misuse, fraud or security concerns.

13. Intellectual Property Rights

All content, software, text, images, trademarks and other materials in the service belong to the Service Provider or their rights holders. Copying, sharing or other use of content without permission is prohibited.

14. Processing of Personal Data

Personal data is processed in accordance with applicable data protection legislation. Further information on personal data processing can be found in the service's privacy policy.

15. Applicable Law and Dispute Resolution

Finnish law applies to these terms. Disputes shall be resolved primarily through negotiation. Consumers may also refer disputes to the Consumer Disputes Board. If the matter is not resolved through negotiation or the Consumer Disputes Board, the dispute shall be settled in the competent district court at the Service Provider's domicile.

16. Amendment of Terms

The Service Provider has the right to amend these terms. The current terms are published on the service's website, and amendments take effect upon publication.
